A. Who These Rules Apply To

Anyone who buys or attempts to buy something through this online shop enters into a relationship with Ayleen Suess (the shop operator). These rules govern that relationship in its entirety. If the buyer has their own purchasing terms, those are irrelevant here and will not be incorporated unless the shop operator has agreed to them separately and explicitly.

People buying for personal, household, or family purposes are treated as private buyers under these rules. People buying in connection with a business, trade, or profession are treated as commercial buyers. The rules treat these two groups differently in certain respects, as explained below.

The shop sells goods either as a one-off purchase or on an ongoing delivery basis. Ongoing delivery arrangements commit the shop operator to sending goods at the agreed frequency for as long as the arrangement runs.

B. How a Purchase Comes Into Existence

Product pages in this shop are not offers in the legal sense. They are invitations for buyers to make an offer. The buyer makes an offer by completing the checkout process and clicking the final confirmation button.

Once the buyer submits that offer, the shop operator has five calendar days to respond. A response can take the form of an order acknowledgement sent by email or fax, the actual shipment of the goods, or a request for payment. Whichever of these happens first marks the moment the agreement comes into existence. If the shop operator does nothing within five days, the buyer's offer lapses and the buyer is no longer bound by it.

When the buyer selects PayPal at checkout, the moment the buyer clicks the final confirmation button also counts as immediate acceptance by the shop operator. PayPal transactions are governed by PayPal's own user terms (available at https://www.paypal.com/de/legalhub/paypal/useragreement-full?locale.x=en_DE) or, for buyers without a PayPal account, by the guest payment conditions (https://www.paypal.com/de/legalhub/paypal/privacy-full?locale.x=en_DE).

After an order is placed, the shop operator stores the agreement text and sends it to the buyer by email, fax, or post. Buyers with a registered account can also view past orders through their account. The agreement text is not published anywhere else.

Before clicking the final confirmation button, buyers can review everything on screen and correct any mistakes using standard keyboard and mouse controls. The browser zoom function can help with reading small text. Once the confirmation button is clicked, the order is submitted as entered.

All shop transactions and order-related communication are conducted in English only.

Order communication happens by email and through automated systems. Buyers must provide a working email address and make sure messages from the shop operator are not blocked by spam filters.

C. Cancelling an Order (Private Buyers Only)

Private buyers have a legal right to cancel a purchase. The details of that right, including the deadline and the steps to follow, are set out in the separate cancellation instructions provided by the shop operator.

D. Prices and How to Pay

All prices shown include VAT unless the product page says otherwise. Any shipping costs are shown separately on the product page.

The shop accepts the payment methods shown during checkout.

Buyers ordering from outside the European Union may face costs that the shop operator has no control over and cannot be held responsible for. These include international bank transfer fees, currency exchange charges, import taxes, and customs duties. These costs apply even when the buyer pays from outside the EU for a delivery within the EU.

Paying by credit card means the full amount is collected the moment the purchase agreement is formed. Credit card processing is handled by Stripe Payments Europe Ltd., 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, Ireland. Stripe may run a credit check and decline the payment method if the result is unfavourable.

Other Stripe payment options work the same way in terms of processor. Stripe may involve further payment sub-processors for specific methods, and those may come with their own separate terms. More information is at https://stripe.com.

Where a PayPal-based deferred payment method is offered, such as paying by invoice or in instalments, the shop operator's right to receive payment is transferred to PayPal or to a sub-processor named by PayPal. Before confirming that transfer, PayPal or its sub-processor will assess the buyer's creditworthiness. If the assessment fails, the shop operator can refuse the chosen payment method. When a deferred PayPal method is approved, payment must be made directly to PayPal or its designated sub-processor in order to count as valid settlement. Despite transferring the payment claim, the shop operator remains the buyer's contact for all questions about the goods, delivery, returns, complaints, and refunds.

Shopify Payments transactions are processed by Shopify International Limited, Victoria Buildings, 2nd floor, 1-2 Haddington Road, Dublin 4, D04 XN32, Ireland. Shopify may use sub-processors with their own terms. More information is at https://www.shopify.com/payments.

E. Shipping and Getting Your Order

Goods are shipped to the address the buyer provides at checkout, within the delivery areas the shop serves. If there is ever a conflict between addresses, the one recorded in the shop's order system at fulfilment time takes priority.

If a delivery fails because the buyer is not available or the address is wrong, and the courier sends the goods back to the shop operator, the buyer pays the return shipping costs. This does not apply if the buyer properly cancelled the order, if the failed delivery was caused by something outside the buyer's control, or if the buyer was temporarily unable to accept delivery without being given reasonable advance notice by the shop operator.

Goods cannot be collected in person.

If a supplier fails to deliver to the shop operator through no fault of the shop operator, and the shop operator had entered into a specific agreement with that supplier to cover the order, the shop operator may cancel the purchase agreement. The shop operator will make every reasonable effort to source the goods regardless. If the goods are wholly or partly unavailable, the buyer will be told promptly and any money paid will be refunded without delay.

F. Ongoing Delivery Agreements

Either party may end an ongoing delivery arrangement immediately if there is a serious reason making it unreasonable to continue. Whether a reason is serious enough depends on all the circumstances of the case and a fair consideration of both parties' interests.

An ongoing delivery arrangement can be ended by a signed letter, by email, or by using the cancellation function on the shop's website.

G. Ownership of Goods

When goods are dispatched before the full price has been received, the shop operator keeps legal ownership of those goods until payment is complete.

H. Problems With Goods

The legal rules on seller liability for defective goods apply to all purchases, subject to the following adjustments for commercial buyers.

Commercial buyers face adjusted rules: the shop operator decides whether to fix a problem by repairing or replacing the item; defect claims for new goods expire one year after delivery; no defect claims are available for used goods; and a replacement item does not reset the claim deadline.

Those adjusted rules do not apply to compensation claims by the buyer, situations where the shop operator deliberately hid a fault, goods built into a structure in their normal manner where they caused damage to that structure, or the shop operator's duty to issue updates for digital content components.

Commercial buyers who are registered merchants under German commercial law must inspect goods promptly on arrival and report any faults in line with section 377 of the German Commercial Code. Goods that are not queried in time are treated as accepted.

Private buyers who notice obvious damage from shipping should tell the delivery company straight away and let the shop operator know too. Not doing this does not affect any legal rights the buyer has over defective goods.

I. Shop Operator Liability

The shop operator is fully liable, without any cap, for: losses caused intentionally or through serious carelessness; physical injury, illness, or death caused by any level of carelessness; guarantees given by the shop operator; and liability under mandatory laws such as the German Product Liability Act.

Where the shop operator is careless but not seriously so, and the failure relates to a core obligation that the buyer was entitled to rely on for the contract to work properly, liability is capped at the level of loss that was reasonably predictable when the agreement was made.

The shop operator has no liability beyond what is described above.

These liability rules also cover the shop operator's staff and any agents acting on the shop operator's behalf.

J. Which Country's Law Applies

German law governs every agreement made through this shop. The international sales treaty known as the UN CISG does not apply. For private buyers, German law applies only to the extent that it does not reduce the protections the buyer would have under the law of the country where they live.

K. Product Claims and Regulatory Notice
